Truepanel Participant Terms, Conditions & Privacy Policy

Truepanel believes in and respects your privacy and the sanctity of information that may be provided. Further, we believe the use of information should be outlined for you as we have done so below. Please read the following policy to understand how your personal information will be treated as you make full use of our many offerings. This policy may change from time to time, and you will be notified upon logging in of any changes – otherwise your acceptance of these terms will apply to your future participation in Qualvu services.

The information we collect is typically user-generated video content, however may also include text entries and ratings of concepts, and is used in aggregate form to help companies understand marketplace needs as well as to create and deliver better products and services. Qualvu does not sell or rent any personally identifiable information.

Truepanel provides our applications as a service to other companies for their use in consumer research. We provide participant video submissions to those companies as part of our services, and as such we encourage you to review the Terms & Conditions and Privacy Policies of those companies who have recruited you, as those are also applicable to the submissions to provide.

The effective date for this Privacy Policy is March 10, 2008.

What personally identifiable information does Truepanel collect from me?

In the course of recording or uploading video, or in the course of using our services, you may have the opportunity to voluntarily submit personally identifiable information (e.g., providing profile information or providing an e-mail address). Truepanel maintains this information in a database, and may use this information to invite you to participate in future projects, or communicate with you regarding projects in process in which you are participating, subject to agreement with the authoring and the respondent-providing client. Your decision to participate in future projects is completely at your discretion. That is, you have no obligation to complete this or any future project.

Once you register you are no longer anonymous to Truepanel – you are given log in credentials which you will use to access the various protected areas of the site. Also, if you contact Truepanel we may keep a record of that correspondence. Wherever Truepanel collects personal information we make an effort to include a link to this Privacy Policy on that page. By participating in a project or in visiting the Truepanel Web site, you understand and consent to this policy.

Who is collecting information and for what purpose?

Truepanel collects information which assists in developing new products, services, messaging, and other research. When you are on a Truepanel site and are asked for personal information, you are sharing that information with Truepanel alone, unless it is specifically stated otherwise. If data is being collected and/or maintained by any company other than Truepanel, you will be notified prior to the time of the data collection or transfer. If you do not want your data to be shared, you can choose not to allow the transfer by not using that particular service.

Any Sensitive Information (i.e. personal information specifying medical or health conditions, racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership or information specifying the sex life of the individual) will be treated with additional care. If Truepanel intends to disclose such information to a third party or use it for a different purpose than originally collected, then you will be expressly asked permission prior to any such disclosure.

Copyright & Confidentiality

You agree that you will not disclose to any third party any information received by you during the course of a survey, questionnaire, Collect, or Videosurvey including the format, the methodologies used and anything or matter whatsoever. Neither will you store, copy, reproduce, transmit, distribute, modify, publish or broadcast any such content or information except as is specifically required for use in the research. You will keep all such material confidential.

What security precautions are in place to protect the loss, misuse, or alteration of my information?

Your Truepanel Account Information and Truepanel Profile are password-protected so that you and only you have access to this personal information.

We recommend that you do not divulge your password to anyone. Truepanel will never ask you for your password in an unsolicited phone call or in an unsolicited email. Also remember to sign out/log off of your Truepanel account and close your browser window when you have finished your work. This is to ensure that others cannot access your personal information and correspondence if you share a computer with someone else or are using a computer in a public place like a library or Internet cafe.

Whenever Truepanel handles personal information as described above, regardless of where this occurs, Truepanel takes steps to ensure that your information is treated securely and in accordance with the relevant Terms of Service and this Privacy Policy.

Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, Truepanel cannot ensure or warrant the security of any information you transmit to us or from our online products or services, and you do so at your own risk. Once we receive your transmission, we make our best effort to ensure its security on our systems.

Notice to Children and Young People

If you are under the age of 13, you may not use any services of our site, or participate in any collect projects.

Incentives

Periodically we request information, typically e-mail address or your mailing address if needed to mail a web cam or participation incentive to you specific to a particular project. Participation is completely voluntary and users may choose whether or not to disclose this information. Your e-mail or mailing address may be shared with the project sponsor to award/provide incentives for participation. Users’ personally identifiable information is not shared with third parties unless we give users notice and choice. Although we may use an intermediary to fulfill incentives, they may not employ users’ personally identifiable information for any secondary purpose.

Use of Cookies

As part of offering and providing customizable and personalized services, Truepanel may use cookies to store and sometimes track information about you. A cookie is a small amount of data that is sent to your browser from a web server and stored on your computer’s hard drive. Some areas on Truepanel where you are prompted to log-in or that are customizable may require that you accept cookies. This avoids you having to enter your login information many times in one day. Most Web browsers automatically accept cookies, but you can usually change your browser to inform you or prevent the use of cookies. If you do not accept cookies, you may not be able, depending upon the individual project, to complete the question or set of questions.

Log Files

Like most Web sites, we log the use of our service. This includes Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks in order to administer the site, track aggregate movement, analyze trends, and gather broad demographic information for aggregate use. This information is not linked to personally identifiable information.

Security

We take every precaution to protect our users’ information. When our users enter sensitive information (such as credit card information), that information is protected using SSL encryption. While on a secure page (such as our Order Form) the lock icon on the bottom of most Web browsers such as and Microsoft Internet Explorer or Firefox becomes locked. Users who have any questions about the security at our Web site are encouraged to contact us as indicated below.

Confidentiality

We are sensitive to the privacy and security of your personal information. However, we cannot guarantee absolute security as such information may be transmitted using the Internet, other public telecommunication networks, servers, hardware or software (“systems”) that are not owned, operated, or controlled by us.

Legal Disclaimer

Though we make every effort to preserve user privacy, we may need to disclose personal information when required by law wherein we have a good-faith belief that such action is necessary to comply with a judicial proceeding, a court order, or legal process served to us.

Communications

Below are the instances when users may receive e-mail communications from our site.

  • Project participation reminders
  • Newsletters (if applicable)
  • If a user wishes to subscribe to our newsletter, we request an e-mail address. Out of respect for our users’ privacy, we enable subscribers to opt-out of these communications by following the Opting-Out practices outlined below.
  • If a user wishes to participate in future projects, we may request an e-mail address. Out of respect for our users'’ privacy, we also enable users to opt-out of future project invitations by following the Opting-Out practices outlined below.
  • Service Announcements
  • On rare occasions it may be necessary to issue a service related announcement (for instance, if our service is undergoing maintenance). These communications are not promotional in nature and users may not opt-out of these communications (although users can deactivate their account).
  • Customer Service Communications
  • At a user’s request, we may communicate via e-mail, chat, or telephone to answer service-related questions. E-mails and/or chats transcripts may be maintained by Truepanel to provide assistance in resolving any inquiries.

Opt-Out Policy

Users who no longer wish to receive our newsletter, promotional communications, or project invitations may opt-out by replying to any received e-mail with “remove” or “unsubscribe” in the subject line or by contacting us as indicated below.

Maintaining, Updating, Deleting, or Deactivating Personal Information

If a user’s personally identifiable information changes (such as zip code, phone, e-mail or postal address), or if a user no longer desires our service, we provide a way to correct, update or delete/deactivate users' personally identifiable information. This can be done by e-mailing Truepanel Customer Support. We may also be reached using the contact information below. Truepanel will respond to any access request provided within 30 days of submitting the request

This Web site may contain links to other sites. Please be aware that we, Truepanel, are not responsible for the privacy practices of such other sites. We encourage our users to be aware when they leave our site and to read the privacy statements of each and every Web site that collects personally identifiable information. This privacy statement applies solely to information collected by this Web site which includes any co-branded Truepanel web sites.

Notification of Privacy Policy Changes

If we decide to change our privacy policy, we will post notification of those changes to this privacy statement on the homepage so users are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. We will use information in accordance with the privacy policy under which the information was collected.

If, however, we are going to use users’ personally identifiable information in a manner materially different from that stated at the time of collection, we will notify users via e-mail. Users will have a choice as to whether or not we use their information in this different manner. However, if users have opted out of all communication with the site, or deleted/deactivated their account, then they will not be contacted, nor will their personal information be used in this new manner.
